To un- hijack this thread, let me say... this is not b.s.

 

I live in a small very provincial town and I am dealing with a custody battle... My status as a single mom is putting my ability to retain custody of my children into question... Yes they actually moved forward on my ex's petition because I failed to get my child at the bus stop...once. Even though I had made arrangements with the other mom at the stop and her son was there to pick up both our kids. The bus driver didn’t let my daughter off , because she didn’t see me.

 

My dating more than one man over the 12 years I have been divorced, has been brought into court... the fact I shared pictures of my kids with my extended family on the web has been made into... I am exposing them to pedophiles... because they found one picture of me ( partial only part of the side of my face... but the ex could recognize me) with another woman on another site all together...due to the stupidity of an ex boyfriend.

 

So don't assume this stuff is just funny... if you are a swinger and your ex finds out... you bet they will "use” it.

 

They will make you out to be someone who should be in a cell next to Jeffrey Damer and child pornographers. Custody and paternity is one of the most endlessly litigious and acrimonious matters that exist.

 

They are nothing but hypothetical... until you get hit with a subpoena on the simple fact you have an adult lifestyle that is totally separate and removed from your children.

 

It is totally insane that in a town with a church on every corner , that the ex who was and is an adulterer is more OK, in the eyes of the court than I am.

This is not as much of a hypothetical as we might think. There was a case in Chicago where 2 people had an affair that (according to the man) included only 3 instances of oral sex. No intercourse. In case anyone wants to look into it further, the names were Mr. Phillips and Ms. Irons.

Sorry you are going through all of this right now. Custody and divorce are often heartbreaking for everyone involved.

 

The best advice I can give you is to always be open and honest with your attorney. It is amazing to me how often clients hide things because they are worried that if they are honest the attorney will make a judgement and not work as hard for them to win.

 

Next, is that as hard as it can be, try to separate your anger for your EX from what is in the best interest of your child. It doesn't take long for the courts to see who is jerking the other parent around and who really cares about the children.

 

Be the first one to suggest family counseling, child counseling, mediation, and bend over backwards to allow the other parent to see the child.

 

The petition about the bus stop doesn't really mean anything, anyone can petition for anything. A lot of the time when this is done the petitioning parent is trying to keep control over the custodial parent, or trying to outspend the other parent in legal bills. I hope your attorney is asking for your EX to pay his/her fees. The judge might not award them every time, but if he keeps bringing you back to court for petty reasons it will happen.

And I've got a friend who returned from being overseas a year in the service of this country to find his wife 3 months pregnant. They divorced and went their separate ways and 18 years later she sued him for back child support and won.

 

Which is one of the reasons I have high contempt and low respect for the legal system and say all this is just mental masturbation.

 

Everything is so twisted and screwed up in the courts and justice is but a fleeting thing rarely seen and even more rarely caught.
