| News Tribune - Local News It's unfortunate that we (swingers) can't think about how our behavior can effect other people when we are out in public. I don't know that I completely believe that the bar owners didn't know what was going on in their party room, I've seen enough bar owners turn a blind eye in the name of profit. But it's important for all of us to realize that our behavior does jeopardize not only the places we patronize but ourselves as well. |

I'm with you Julie, I find it hard to believe they didn't know what was going on in a private room...and they probably turned a blind eye in the name of profit. I wonder if we got all of the details? A permanent revocation for lewd behavior?...seems a bit like losing a finger over a parking ticket. This does, however, highlight our responsibility as swingers when in public. We can't have sex in public venues...there's a possibility that someones liquor license could be revoked...permanently. Or, people could get arrested, us included. We know a couple that refuses to go to "swing clubs" because she swears that the indecency laws are so broad in Florida that we are at risk even being in the place. The organizer of a party series here in Florida absolutely does not allow sex at any of his events...we have crossed the line a time or two and have been scolded harshly by security, although Mr. Joshua didn't remove any of my appendages. It seems that we need to be careful for our sake as well as others...I'm not sure it would occur to everyone that their actions could cause trouble for the owner of the establishment as well as themselves. It's more than just having sex in public. I think the offenses would have been more than just "lewd behavior" if sex was involved, BUT "lewd behavior" doesn't take much more than removing clothing or even flashing. With 21 counts I have a hard time believing it was too much more than that, but it could have just as easily been the full spectrum of things as well (and some counts may have been reduced to "lewd behavior". I've seen plenty of clubs that allow all sorts of things in their main club with the idea that "it's a private party" so it doesn't matter... funny thing... if you don't black out the windows at one bar in particular, when you drive up you can see everything going on inside as your headlights shine right in (including all the topless women).... but hey the bar is making money and that group has a place to go and doesn't see it as their problem as long as the bar doesn't care. |

States are very specific about what can go on where liquor is involved. Living in Mississippi, I used to know the law pretty good because I used to work in a swingers club that had their own liquor license. The law is very specific here. The owner every had it listed in the restrooms for all to read.

This does not just happen in "small towns" either. In the last two years here in Vegas. Three independent owned bars lost their Liquor license, Business License and gaming license. Yes, all three closed. (this happened because patrons felt the need to have sex in the bars) One of the major hotels got fined $275,000 dollars for allowing Swinger type play to go on in their bar. (girls flashing their tits) Another Hotel was fined $750,000 but only had to pay $250,000 of it up front and won't have to pay the other $500,000 if they follow the laws for the next year. That hotel kicked out the night club that was in their casino/hotel because of it. The people that owned that night club was trying to get a new Business License to open another place in another major casino here in Vegas this month. They have spent over TWO MILLION dollars building the club now the county is refusing to give them a business license. Not only have they lost the Two Million it cost to build the new club but how much more are they going to lose now that they can not open. They had employees hired to open this weekend. Couple Hundred more people are now out of work. Yes, we all want what we perceive as our "rights" but some don't think about what it is costing others. |

My point to the original story was that the club in question was, as I recall, closed to the general public on the night in question, and that everyone in the room (besides the undercover whatever) was a consenting adult that knew what kind of event they were going to and went anyway of their own free will. Licenses premises or not, as a free people we should have the right to do that without interference from law enforcement. Yes they broke the "rules". These rules shouldn't exist. |

It really doesn't matter if they closed to the general public or if it's a private party they are still held to the same laws and requirements they are responsible for the rest of the year. Liquor laws typically have restrictions on nudity PERIOD. If alcohol is being served the bar is responsible to maintain the same laws regardless of whether they are open to the public or having a private party that night. Here's two things I've seen happen locally. Example 1 - Regular night club had a Friday night deal where they had a local radio station and sex toy store sponsor their Friday Night parties. Toys were given away. One night during one of these parties someone decided to go using their new toy at the club. Someone saw them, the club got turned in and lost their liquor license. Example 2 - A local bar hosts a monthly swinger party. The bar is closed to the public but the responsible bar owners and club hosts not being so responsible allow nudity in the bar. The problem is that the way the windows are in this place (and since they don't cover them for the parties) anyone could pull up in front of the bar with their headlights on and see exactly what is going on in that "private" party. You can say it's a "private" party all day long but it's up to the club owners (both the swinger club and the bar) to ensure that they are still being legal and following whatever laws are required for them to maintain their liquor license and any other licenses they are required to maintain. 9 out of 10 swinger clubs I've seen go down have gone down because they avoided following local law and getting proper licenses (basic business licenses, occupancy licenses, or by breaking liquor license law). Is it possible to be lewd responsibly? Yes. But it takes work on the part of the club owners as well as responsibility of each person at the party. Too often the club patrons assume that the owners have done their job to ensure legality and therefore believe they can do whatever they want once they are inside... that's not the case. If something does happen and a party is busted because the club owner failed to be responsible, everyone in that party/club CAN be held responsible for whatever actions they are partaking in when the place is busted. |
